DMEPOS Supplier Final Rule Released

The Centers for Medicare & Medicaid Services (CMS) has released a final rule on Revisions to the Durable Medical Equipment, Prosthetics, Orthotics, and Supplies (DMEPOS) Supplier Safeguards (77 FR 14989 [March 14, 2012]). The final rule adopts the proposed rule, removing the definition of “direct solicitation” and allowing DMEPOS suppliers, including DMEPOS competitive bidding program contract suppliers, to contract with licensed agents to provide DMEPOS unless prohibited by state law. It also removes a requirement for compliance with local zoning laws and excepts licensed non-physician practitioners – including occupational therapy practitioners – from a 2010 requirement that supplier offices be open 30 hours per week
